Privacy Notice for California Residents


1. Collecting Information

• For the categories of personally identifiable information mentioned, add any other categories you collect online, and delete the ones you do not collect. Refrain from collecting any unnecessary personal information, especially information of a sensitive nature (e.g., social security numbers).
• For the types of Web tracking tools mentioned, add any other tools you use, and delete the ones you do not use.
• For the types of tracking data mentioned, add any other types you collect, and delete the ones you do not collect.
• You must explain in detail how your site responds to a consumer’s Do Not Track signal. In the sample privacy policy below it states quite simply that the DNT signal is not blocked.
• You must also state whether other parties may track the consumer’s online activities.

2. Using Information Collected

• Change, if appropriate, the procedure for users to opt out of further communications from you.
• Identify any categories of third parties with whom you may share personally identifiable information collected online. If you share consumer information with third parties for direct marketing purposes, you may be required to comply with the Direct Marketers Disclosure Law (Senate Bill 27). This may involve, among other things, disclosing in your privacy policy that customers have the right to submit a request for information about third parties (Cal. Civ. Code § 1798.83(b)(1)) (see Question 17).
• Identify any specific affiliates with whom you share personally identifiable information, or delete the reference to affiliates if you have none.
• Disclose, if appropriate, that you share personally identifiable information with an affiliate that has a different privacy policy than yours.
• Provide a procedure, if any, for users to opt out if they do not want their information to be shared with affiliates or other third parties.
• Identify the steps, if any, you take to protect the security of the information collected.

3. Updating Information

• Change, if appropriate, the procedure for users to review or request changes to their information.

4. Updating Our Privacy Policy

• Change, if appropriate, the procedure for users to be notified of changes to your privacy policy.

5. Contacting Us

• Provide your contact information (e.g., name, company name, address, e mail address, and telephone and fax numbers). For a company Web site, consider designating someone in your company to be the contact person for these administrative matters.

6. Effective Date

• 1/1/2020.

7. Other Considerations

• Customize the sample policy by inserting your name or your company's name where appropriate.
• Display your privacy seal if any (see Question 12).
• Do not target children; otherwise, you may be required to comply with the requirements of the federal Children’s Online Privacy Protection Act (see Question 19).
• This sample policy may not comport with online privacy laws of other states.

OUR PRIVACY POLICY

Because we value your patronage, we want to address any privacy concerns you may have. To that end, we have set forth our privacy policy for handling the information you share with us online. We want your decision to do business with us to be an informed one.

1. Collecting Information

When you visit our Web site, we may collect information about you that you voluntarily choose to share with us. This identification information may include, but is not limited to, your name, your physical address, your e mail address, your telephone and fax numbers, details of your real estate and lending needs and preferences, and other details of your life. What may be less obvious to you is that, when you visit our Web site, we may collect data involving your usage through the use of "cookies" (i.e., small text files placed on your computer by a Web site), Web server logs, and other Web tools. This technology allows us to customize your online experience, as well as track your Internet use. The tracking data we collect may include, but is not limited to, the date and time you visit, the time you spend, the Web pages you view, the other Web sites you visit, your search queries, and basic information about your computer, such as your Internet Protocol ("IP") address, your domain name, your browser type, and the name of your Internet service provider. In the same way, our affiliates may also track your Internet use but we do not permit this by unaffiliated third parties. You may deactivate cookies if you do not want your browsing to be tracked, but doing so may hinder your online experience. Nor will we block your browser’s Do Not Track signal. When visiting our Web site, you may be directed, through hyperlinks, to other Web sites that are beyond our control. Furthermore, when you are visiting our Web site, other companies, such as third party advertisers and sponsors, may be gathering information about you. This Privacy Policy does not cover the collection of information by those other companies and Web sites. Although we encourage third parties to provide their own privacy policies, we are not responsible for their activities, such as how they handle the information they collect online.

2. Using Information Collected

We primarily use the identification information you voluntarily share with us to customize your online experience and to do what you have asked of us. We also use your identification information to tell you about our products and services, but you may instruct us not to send communications to you by following the procedure indicated below under "Contacting Us." On occasion, we use your identification information to validate your identity. As for usage tracking data, we primarily use that information to operate and improve our Web site, and to further our marketing efforts. As a general rule, we do not share your information with unaffiliated third parties. We may, however, share your information with our own personnel and our service providers to the extent necessary to fulfill your requests. We may also share your information with our affiliates, but we will not share it with unaffiliated third parties for direct marketing purposes. We reserve the right to disclose your information under limited circumstances, such as to cooperate with law enforcement or judicial authorities as required by law or legal process, to protect our own legal rights, or to protect the public good. We may, from time to time, change our Privacy Policy. We will notify you of any changes by posting our updated Privacy Policy on our Web site and inserting a new "Effective Date."

5. Contacting Us

Under California law, California residents have the right to request in writing from businesses with whom they have an established business relationship (1) a list of personal information, such as name, address, e-mail address, and the type of services provided to the customer, that a business has disclosed to third parties, including affiliates, during the immediately preceding calendar year for the third parties' direct marketing purposes and (2) the names and addresses of all such third parties.

This Privacy Policy is effective as of 1/1/2020.
